Full Foreign Property Ownership in Belize
Can Foreigners Own Property in Belize?
The answer is… YES, absolutely!
One of the biggest draws to Belize real estate is the fact that foreigners can own property in Belize.
Unlike many countries that impose restrictions on foreign ownership, Belize allows non-citizens to purchase property outright with full freehold ownership. Foreigners enjoy the same property rights as Belizean citizens, with no requirement for local partners or complex trust structures. This transparency, underpinned by the British Common Law system, makes contracts and due diligence straightforward.
Belize is one of the most welcoming countries for foreign real estate ownership in Central America and the Caribbean. A key reason for this is that its legal system is based on English Common Law, which is familiar to many buyers from the U.S., Canada, and the U.K.
When buying property in Belize, non-Belizean owners and investors have Equal Rights. This means that foreigners have the same property ownership rights as Belizean citizens. In Belize, foreigners can own land and buildings outright with a “fee simple” title, which is the strongest form of property ownership.
There are no legal restrictions on foreign ownership of land, including beachfront or coastal properties, which is a significant advantage over many other countries in the region. The full foreign ownership and investor-friendly environment give Belize a distinct advantage over other Central American and Caribbean destinations.
Belize removed any foreign real estate ownership restrictions in the early 2000s. The “Alien Landholding Act,” which previously required foreigners to obtain a special license to own land, was abolished in 2001.
Types of Property Ownership
Belize has several types of titles. You can learn more about the different distinctions:
- Fee Simple: This is the most common and secure form of ownership. It grants you full rights to the property, including the right to sell, lease, or develop it as you see fit.
- Deed of Conveyance: This is a legal document that transfers ownership of a property. It is most common for land in unregistered or undeveloped areas. The Deed of Conveyance is a strong title, though it doesn’t offer definitive proof of ownership until it is registered with the Lands Department.
- Land Certificate or Transfer Certificate of Title: Certificates and ownership of this nature are issued by the Belize Lands Department for surveyed land, especially in urban or more developed areas. They serve as a clear, government-issued proof of ownership under the Registered Land Act.
- Strata Title: Primarily used for condos and multi-unit developments. This means you own your individual unit plus a share in the common areas.
- International Business Company (IBC): Many foreigners choose to own property through a Belizean IBC. This can provide benefits like asset protection and potential tax advantages, including a lower stamp duty rate (transfer tax).
